🢠1. What It Is The Spouse Visa is a type of UK Family Visa that allows an individual to join their partner in the UK. The partner in the UK must be a British citizen, a person with Indefinite Leave to Remain (settled status), or someone with refugee status or humanitarian protection.
This visa is granted for an initial period of 2.5 years and is a direct route to settlement. After completing five years in the UK on this visa, the holder can typically apply for Indefinite Leave to Remain (ILR).
📜 2. Who Can Apply An individual can apply for this visa if they are the spouse or civil partner of a person who is British or settled in the UK. The core eligibility criteria are:
- Both the applicant and their UK partner must be 18 years of age or over.
- They must be in a legally recognised marriage or civil partnership.
- Their relationship must be genuine and subsisting, and they must intend to live together permanently in the UK.
- Any previous relationships for either partner must have permanently broken down.
🔑 3. Key Requirements The Spouse Visa has some of the most stringent requirements in the UK immigration system. The main ones include:
- Financial Requirement: The UK-based partner (the sponsor) must prove they meet a minimum income threshold, which is currently £29,000 per year. This can be met through employment, self-employment, cash savings, or other specified sources.
- English Language Requirement: For the first visa application, the applicant must pass a secure English language test in speaking and listening at a minimum of CEFR Level A1.
- Genuine Relationship: Applicants must provide substantial evidence to prove their relationship is genuine and ongoing. This can include marriage certificates, joint financial documents, photographs, and communication logs.
- Adequate Accommodation: The couple must show they have adequate accommodation for themselves and any dependents, which they own or occupy exclusively, without recourse to public funds.
